PERSONAL DATA PROTECTION POLICY 

  • For the purposes of the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, NEWFISH S.L. informs the User of the existence of an automated file of personal data created with the data obtained on the Portal by and for NEWFISH S.L. and under its responsibility, with the aims of information and marketing of the products offered on the Portal, as well as carrying out promotional and advertising activities that may be of interest to them, to expand and improve our Products by adapting our offers to their preferences or needs and to allow personalized browsing. 
  • The user expressly accepts the inclusion of the data collected during browsing the Portal, or provided by filling out any form, as well as those derived from the commercial relationship and/or delivery of the purchased products, in the automated personal data file referred to in the first paragraph. During the data collection process, the User will be informed of the mandatory or non-mandatory nature of collecting such data for the delivery of the Products, except for placing orders, in which case NEWFISH S.L. informs the User from this moment that it will not be considered voluntary, and therefore their inclusion will be necessary for the formalization of the purchase order, providing data relating to identity, address and credit card number to make the payment, as this data is necessary for the formalization and conclusion of the sale. 
  • The User may exercise, with respect to the data collected in the manner provided in the previous section, the rights recognized in Organic Law 15/1999, and in particular the rights of access, rectification or cancellation of data and opposition, if relevant, as well as the revocation of consent for the transfer of their data. USER RIGHTS AND OBLIGATIONS 

The use of any of the services offered on the WEBSITE, from its beginning, confers the status of User and will be considered an express, voluntary, and unreserved acceptance of these General Conditions. To access the services of the Website, for all that is not free of charge or imposes a series of obligations, the User must be of legal age and have the necessary legal capacity and representation to contract. 

The use of the services offered on the WEBSITE implies that the User declares to meet these requirements. 

The User accessing the WEBSITE must comply with these General Conditions and the special instructions for use shown to them at any time. Likewise, they undertake to always act in accordance with the law, good customs and the requirements of good faith, employing the diligence appropriate to the nature of the service they enjoy. Thus, the User may not make any modification or alteration to the contents of the Website, with the exception of the data that the User has entered themselves, nor will they damage its integrity or operation in any way. 

The personal data that users must provide to access the aforementioned services will be subject to the general legislation on data protection. NEWFISH’S LIABILITY. 

NEWFISH S.L. reserves the right to make modifications to the Website, as well as to these General Conditions. 

Furthermore, and given the special nature of the medium chosen to communicate with Users, NEWFISH S.L. cannot assume responsibility: 

  • For the temporary impossibility of accessing the Website at a specific time, or the specific information among those included in NEWFISH S.L. or on those Websites that the User accesses through hypertext links located on the Website.

All content, trademarks, designs, logos, icons, buttons, software, trade names, domain names, and any other signs or elements susceptible to protection by intellectual and industrial property rights that are part of the WEBSITE are the property of NEWFISH S.L. or are in the public domain or belong to third parties who have duly authorized their inclusion on the Website and who appear as the authors or holders of the rights.In no case shall it be understood that any license is granted or any renunciation, transfer, total or partial assignment of said rights is made, nor is any right conferred, and especially those of exploitation, reproduction, distribution, transformation, or public communication regarding said content without the express prior written authorization of NEWFISH S.L. (with respect to the site design or the use of the “NEWFISH S.L.” brand) or the corresponding third parties. 

Violations of any of the intellectual or industrial property rights referred to in this section will be prosecuted through the criminal and civil actions contemplated in current legislation.
